How much time do you think he's looking at?
My husband's exwife called the cops and made a statement last may in 2010 in Indiana. Stating that my husband broke into her house, was waving a knife around, and grabbed her arm causing "pain". So right now they have him in jail awaiting his hearing. The warrant was for a cl c felony for intimidation, a cl d felony for breaking and entering, a cl d felony for domestic battery and another cl d felony for domestic battery again because she said the kids were inside sleeping. According to the affadavit there was a gentlemen that says he say my husband pull in the parking lot, and saw him leave later, but never witnessed anything else. For one, my husband has 5 witnesses that were with him that afternoon as he was at a friends house in kentucky doing some tattoo work, they know what time he got there and what time he left. He then after finishing the tattoos left to come home (in kentucky) and on the way got pulled over and got a ticket that night. His ex wife says she refuses to testify as she said its been over a year ago and there are no problems now, we all get along. And from what I've been told this other guy that was on the affidavit moved outta state and hasn't been seen or heard from. According to the affidavit the police put out an apb that night on our car when they got to the scene, but again my husband got a ticket that night in kentucky but never was taken in. But the officers called at 2 different times after this to ask questions. The first call came in june, at which time my husband told them he was never even in indiana that night. The second call came a month later, at which point my husband said he apparently got dates mixed up, cuz when asked by the officer if he'd been to his ex wifes house he answered yes. So they have it in the report as he denied to one officer being there, but agreed to the second officer but stated nothing ever happened. Unfortunately his ex wifes boyfriend at the time was trying to cause trouble as he kept calling our home and saying all kinds of crazy things regarding our children. So my husband got upset and called back and left a message saying he'd kill him if he ever got around the kids. Obviously when it comes to our kids we are very protective and sensitive. Either way they have these recordings. They have now filed an intent to proceed with enhanced prosecution. What does that mean? What am I looking at here? We have 5 children and I'm afraid he's gonna end up sittin in jail for 10-12 years now. And please if you have nothing to say except a snide comment or something than please don't. I'm a full time med student now home alone, with 5 kids and going to school full-time and with no help now. I've never dealt with any of this stuff and I'm so lost I don't know where to even begin. And unfortunatley am not able to afford an attorney so he's going to end up with a court appointed one, and I'm afraid he's screwed. Please help!
